Do the authorities have the right to require copies of your emails for a running investigation? And if those emails were deleted, is it possible for the email provider to recover them? I know there is a certain period for companies to retain data on their servers. But I'm not sure if that period depends on the provider or is the same for everyone.

I just operate under the assumption that anything that you write in an email is retrievable if it comes down to it, but of course it never really does for the majority of us. I am sure that a lot of people would like to ask this question to Hillary Clinton and see what she would have to say after that whole situation. I am sure that it varies, but it seems like there have been some cases in the news recently where emails played a large role and they were recovered somehow.

Email services providers often will "permanently" delete emails in your trash folder after a given number of days [30 for most of them].

But a deleted email really isn't lost or gone forever. Since an email originates at some point if law enforcement wanted to recover your emails they would. They'd just take a look at your contact list, contact the email service providers and take a look at mail that was sent to you [since that (sent mail) never is deleted].

Deleted emails and undeleted messages in your spam box only last for 30 days, after which they are completely erased. Providers may be able to retrieve them but with so many emails deleted on a daily basis, that is like looking for a pin in a stack of hay. Unless pay them a hefty fee or what you deleted is of national concern or something which has the power to change the course of our world, then they may brush off any retrieval request.

Unless it is a serious national or international offense, E-mail retrieval is not an option. Spam and deleted E-mails are stored only only for 30 days and it is indeed possible for them to retrieve them but it will be a herculean task but yes, it is indeed retrieval. A government has every right to ask for it if required.

As others have said, 30 days is the norm for email service providers to keep deleted emails, and that may vary from country to country, I think that's pretty much standard practice.

Here in the UK it comes under the data protection act, and companies are legally obliged to destroy permanently any data after a certain amount of time.

On a side note, that's also the reason why you can't go back and exchange goods for a full refund after 28 days because the company you have bought the item from destroys their copy of the receipt of sale, and even though you might have kept your copy, they can't verify your purchase as they have had to by law, destroy that receipt at their end.

I can't really answer the question as to how long, but I'd like to give my two cents on the matter. Can you retrieve deleted emails? Yes, most likely. In my uneducated guess, when you delete emails from their server, they do not actually delete them on their servers, it just seem deleted because that's what the browser is showing you. Not to mention these email providers probably have multiple backups of your email. So yeah, you have the original and backups. It would take a while before your email gets completely wiped out from the moment you "delete" the email. But yeah, the period they keep your emails is probably different across email providers.

Yes, of course, I forgot to realize that this is a two-way communication, there is a source and a receiver. This is an easy solution to retrieve deleted emails from one side.

A lot also depends on how deep you want to go into it, and in reality EVERYTHING that is just deleted can be retrieved if you have access to that hard drive or server. The only way something can be deleted permanently is if the file is wrote over

Well when it comes to issues of security and personal information I have always just assumed the worst and that is that the information is just out there forever for people to find. In terms of how long they are actually in the inbox and available for personal use is one thing, but then I always think about admissible in court type like scenarios and those I can see there being no expiration date on that information.

The short answer is the emails can be retained as long as needed. Any employer generally retains emails from ex-employees for 1 year, but there are others that retain emails for as long as 5 years. And they also get you to sign on that in one way or the other. As far as google is concerned, they basically keep records forever. There is no reason to delete mails since they don't really take up that much space anyways.

I doubt if even Google know the answer to how long the emails are kept in their system either to be honest. Some say forever, some say 180 days, who's going to be able to prove it? Or more importantly who's going to be able to make Gmail prove it?

Yeah. Also, there is no reason for Google to delete any mails. As long as they are a US-based company, they'll always need to retain mails ad infinitum. Its just safer that way.

If for the sake of an investigation they want to get details pertaining to all the emails you sent/received and deleted, I think the service provider will be able to give the investigation team all the necessary information. I know that if you use Microsoft Outlook then there is a high probability of restoring deleted mails by modifying the registry in Windows. I don't know how it works with other email providers.

In my country, the inland revenue board requests a company to keep the tax related data and supporting documents for at least 7 years.

I think you have a right to remove any emails from the account. Archive included this can be a good idea to delete them. Google suggests retaining emails as they have big space. But overall I have found that it'd be beneficial to make use of the delete option instead. On legal or not , it's safe to remove the emails that being sent.

Emails don't last forever in the mail box because the box has capacity of mails it can store, older mails are auto deleted as new ones comes in especially if the box is filled up. Deleted mails can be retrieved from the server data base because any files deleted in clients box still goes to server data base.

They can take your mails, but I think they should not delete them. You can ask your email provider to give your mails back. Actually, nothing that is on the Internet once can not be deleted. Never! So, they can give your mails back to you.

Email can be in the mail box as long as it still valuable.I know I stored emails for so long a time and it still remained stored but providers I'm sure they have archive for mails to be there for as long as they want and could be retrieve at any point in time.

Providers may be able to recover them for legal purposes. Everything you do online has a trace, and you will most likely be caught. I think Authorities can check emails if they are suspicious about anything illegal

Depends on your country and laws they have to follow. In most cases deleting is not actually deleting of course.
Google for example stores their email in offline storage, which means your emails could be there for as long as they want. They say its up to 60 days to comply with European data laws.
When you click the delete button it only removes the online copy of the email.
So yes emails get deleted, but they don't really get deleted.
