I have a friend who works as an overseer of a company , and he has learnt many things about the business of the company .
He wants to leave the company to start his own type of the company's business , and he is afraid the company may sue him .
Are there laws that ban employees from doing so ?
 
Depends on each company policy and the country where the company your friend is working is based/registered. He should be negotiating with his superior before leaving.

The problem is that he plays a vital role in the company , and the company won't want to let him off easily .
There was no initial agreement that he can't leave the company though .
 
i don't think that there's such a law, it's been working always like that, even in small jobs, once you get the skill, you start your own business since you gathered enough experience
 
I don't think there is such law , if you have gained the experience you can start up your own ,provided you did not commit any crime or steal their funds
 
He can only be subjected to judicial process only if he signed a contractual agreement with the company or stated expressly in his/her appointment letter. If not, he/she can go on to set up his/her own company provided he/she has the necessary requirement and skills.
Yeah I think thats the only way , because if he/she starts his own company , they might use that signed documents against him and he /she will have to face the consequence
 
I don't think there is any law against you starting a similar/same business to your previous working place
But its rather advisable to sought for more opinion before venturing
 
...which is so 'wicked' in the sense of you in a position (probably occasional promotion) which won't be so convincing in taking a step in ones career
 
If agreement is sign then such agreement can't be breach but if there is no agreement he can easily leave the company to start his own company but he should ensure he has no financial scandal as the company will not be happy his competing with them so any scandal can be used against him.

you gained experience to boost your new company, so you should appreciate it, without the former company you wouldn't be able to know a lot

That's the point , moving out from the former company to start a business that sells same product or similar to former business , appears to be an act of betrayal.
 
I specifically denied that no company can hold someone right for resignation if you want to leave a company to start your own business there is only one thing you need to do that is resign ,but you can let your boss know the reason why you want to resign thou it may be stated in the resignation sheet.

Well that's true .he has made up his mind to move irrespective of what the company may think of him . he has a good idea on how to improve the business when he starts his own .
 
Any company that isn't yours could up and fire you in an instant. I think it will only be betrayal if the person pulling out was sinister enough to pull the company's customers and core workers with him. If not, he just needed the old company as a learning platform and it's time for independence.

I don't know if there is such a law here in my country, but I have seen many people do that without being sued. I think it is just like that and everyone is allowed to compete. So you use the skill you have learnt from working in a company to open your own company.
 
Then you should fine out if you really want to know about that,in my country there is nothing like that anyone that is working in any firm is entitle to resign from the firm and start up his own business the decission must be well access before you can take that decission because when you resign you can never be reemploy again.
 
Well I do not think there is going to be any trouble trying to set up his own business except if here is an agreement between him and the company, company policies can never include against staffs setting up their own business even the government of a nation wants establishment all over the country so as to boost the economy.
